1. About These Terms
This website is operated by TheMemoryOrbs (“we,” “us” or “our”). By browsing this site or buying from us, you agree to these Terms of Service, along with our Refund Policy, Shipping Policy and Privacy Policy. If you don’t agree, please don’t use the site.

We may update these terms from time to time. The latest version will always be on this page, and continuing to use the site after a change means you accept the updated terms.

Our store runs on Shopify, which provides the platform we use to sell our products.

2. Using Our Store

  • You must be at least the age of majority where you live to place an order, or have permission from a parent or guardian.
  • You agree not to use our products or this site for anything illegal or unauthorized.
  • You agree not to upload viruses or harmful code, or interfere with how the site works.
  • We may stop providing service to anyone who breaks these terms.

3. General Conditions

  • We may refuse service to anyone, for any reason, at any time.
  • Payment details are always encrypted. Other information you send us may pass across different networks as part of normal internet use.
  • You may not copy, resell or reuse any part of this site, including its text, images and design, without our written permission.
  • Section headings are for convenience only and don’t change the meaning of these terms.

4. Accuracy of Information
We work to keep everything on this site correct and up to date, but we can’t promise it’s always complete or current. Information is provided for general reference, and we may update it at any time without notice.

5. Prices and Changes to Our Store

  • Prices can change without notice.
  • We may change, pause or discontinue any product or part of the store at any time.
  • We aren’t liable to you or anyone else for price changes, product changes, or the store being paused or closed.

6. Products

  • Our products are sold online, may be available in limited quantities, and are covered by our Refund Policy.
  • We do our best to show product colors and images accurately, but how they look depends on your screen.
  • We may limit sales of any product to any person, household or region, and may limit quantities.
  • Product descriptions and prices may change at any time. We may discontinue any product at any time.
  • Each Memory Orb is a display device for your own videos and photos. Results depend on the files you load onto it, and some file conversion may be needed, as explained in the included instructions.

7. Orders and Billing

  • We may refuse or cancel any order, or limit quantities per person, household or order. This includes orders using the same account, card or address.
  • If we change or cancel your order, we’ll try to contact you using the email or phone number you gave at checkout.
  • We may limit or refuse orders that appear to be placed by resellers or distributors.
  • You agree to give us accurate, current purchase and contact details, and to update them if they change, so we can complete your order and reach you if needed.

8. Third-Party Tools and Links

  • Our site may use or link to tools and websites run by other companies, such as payment providers, shipping carriers and tracking services. We don’t control these services, and they’re provided “as is.”
  • We aren’t responsible for third-party websites, their content, or any purchases you make through them. Please read their own policies before using them.

9. Reviews, Comments and Feedback

  • If you send us reviews, photos, ideas or other feedback, you agree we may use, edit, publish and share them in any medium without paying you or keeping them confidential.
  • You agree that anything you send won’t break anyone’s rights, won’t be unlawful, abusive or obscene, and won’t contain harmful code. Don’t use a false email or pretend to be someone else.
  • We may remove any content we consider unlawful, offensive or in breach of these terms. You’re responsible for what you post.

11. Errors and Corrections
The site may sometimes contain typos, mistakes or missing information about products, pricing, promotions, shipping times or availability. We may correct errors, update information or cancel orders if something is wrong, even after an order has been placed. If we cancel an order for this reason, we’ll refund you in full.

12. Prohibited Uses
You may not use this site or its content to:

  • do anything unlawful, or encourage others to;
  • break any local, state, national or international law;
  • infringe our intellectual property or anyone else’s;
  • harass, abuse, threaten or discriminate against anyone;
  • submit false or misleading information;
  • spread viruses or harmful code;
  • collect other people’s personal information;
  • spam, phish, or scrape or crawl the site;
  • get around the site’s security features.

We may end your use of the site if you break any of these rules.

13. Disclaimers and Limitation of Liability

  • We can’t promise the site will always be available, uninterrupted, secure or error-free.
  • Except as stated in our Refund Policy, our products and site are provided “as is” and “as available,” to the fullest extent the law allows.
  • To the extent permitted by law, TheMemoryOrbs and its owners, suppliers and service providers aren’t liable for any indirect, incidental or consequential losses, including lost profits or lost data, arising from your use of the site or our products. Our total liability for any claim is limited to the amount you paid for the order in question.
  • Some states and countries don’t allow these limits, so they may not fully apply to you. Nothing in these terms removes rights you have under consumer protection law.

14. Indemnification
You agree to cover TheMemoryOrbs and its owners, partners, suppliers and service providers against any claim or demand, including reasonable legal fees, made by a third party because you broke these terms or the law, or infringed someone else’s rights.

15. Severability
If any part of these terms is found to be unenforceable, it will be applied as far as the law allows, and the rest of the terms will still apply.

16. Termination
These terms apply until ended by either of us. You can end them by no longer using the site. We may end them at any time, without notice, if we believe you’ve broken them. Anything you owe up to that point still applies.

17. Entire Agreement
These terms, together with our other policies on this site, are the full agreement between you and us, and replace any earlier versions. If we don’t enforce a part of these terms, that doesn’t mean we’ve given up the right to.

18. Governing Law
These terms, and any separate agreements under which we provide you products or services, are governed by the laws of the United States.
